A local resident has been issued with a £200 fixed penalty notice for failing in their duty of care to ensure their waste was passed to an authorised person, who would dispose of it properly.
The waste, which contained a mattress, a chair and numerous other household items was found fly tipped in Clowne. It was investigated by our enforcement team and subsequent fixed penalty notice was issued.
Householders have a legal obligation (duty of care) to take all reasonable measures to ensure that your waste is disposed of properly. The Environmental Protection (Duty of Care) Regulations require all householders to make sure their waste is only removed from their premises by registered waste carriers.
