The development plan for the District is currently made up of the documents below read together. Where there is any conflict between the policies contained in these documents, the policy in the most recently published, adopted or approved document prevails. 

Bolsover District Local Plan

The Bolsover District Local Plan (February 2000) contains local and site specific policies on general development issues, housing, employment, shopping and town centres, community facilities, recreation, leisure and tourism, transport, conservation of the historic and built environment. It also allocates sites for specific development.

We asked the Secretary of State to consider action to ‘save’ many of the policies of the Bolsover District Local Plan beyond 28th September 2007 under provisions in the legislation. The Secretary of State agreed to our request and these ‘saved’ policies will remain in force until they are replaced by new policies.

Supplementary Planning Documents

Whilst not part of the Development Plan, certain policies of the Bolsover District Local Plan are currently supported by the following supplementary planning documents:

Affordable Housing SPG (adopted February 2002)

The Affordable Housing Supplementary Planning Guidance document was adopted in 2002 as a material consideration to provide further clarity and interpretation for policies HOU 6 and HOU 7 of the Bolsover District Local Plan. As these two policies were ‘saved’, they will remain in force until they are replaced by new policies in our New Local Plan.

Historic Environment SPD (approved 1st March 2006)

The Historic Environment Supplementary Planning Document was adopted in March 2006 to provide further clarity and interpretation for policies in the Bolsover District Local Plan in relation to listed buildings, conservation areas, conversion of historic agricultural buildings and archaeology.

As these policies were ‘saved’, they will remain in force until they are replaced by new policies in our New Local Plan.

New Bolsover Model Village Planning Guidelines SPG (adopted November 2002 updated October 2008)

The New Bolsover Model Village Planning Guidelines Supplementary Planning Guidance was adopted in 2002 as a material consideration to guide those proposing to carry out works to the Grade II listed New Bolsover Model Village houses by identifying the features which are important to the special architectural or historic interest of the properties.

The document was updated in October 2008 to include information on works for which listed building consent and planning permission have already been secured, to revise the information provided in the Building Regulation Consent section and to make changes to the contact details for the Council and the Building Control Service.

Successful Places SPD (adopted October 2013)

We adopted Successful Places: A Guide to Sustainable Housing Layout and Design as an Interim Supplementary Planning Document (SPD) on the 2nd October 2013.

The purpose of the Successful Places is to promote and achieve high quality residential development within the District by providing practical advice to all those involved in the design, planning and development of housing schemes. The guide is applicable to all new proposals for residential development, including mixed-use schemes that include an element of housing.
The guide currently supports the saved policies of the Bolsover District Local Plan and has been prepared to support the emerging policies of the new Local Plan and has been adopted to be used as a material consideration in the determination of planning applications.

The Planning and Compulsory Purchase Act 2004 requires us to undertake a number of monitoring duties. As part of this, we have prepared Monitoring Reports on a largely annual basis since 2004 that cover the delivery of the Bolsover District Local Plan and these can be found on our Development Plan Monitoring page.

Derby and Derbyshire Minerals and Waste Local Plans

The Derby and Derbyshire Minerals Local Plan (April 2000) (as altered in November 2002) sets out planning policies for minerals development. Most of its policies have been saved and will remain in force until they are replaced by new development plan documents. The Minerals Plan is supplemented by Supplementary Planning Guidance on the After-uses of Sand and Gravel Sites.

The Derby and Derbyshire Waste Local Plan (March 2005) sets out planning policies for waste development. All but one policy (policy W1A) of the Derby and Derbyshire Waste Local Plan, adopted in March 2005, have been saved beyond March 2008.

Proposals for the replacement of these policies are contained within the Minerals and Waste Development Scheme prepared jointly by Derbyshire County Council and Derby City Council.

 The Town and Country Planning (Brownfield Land Register) Regulations 2017 requires the Council to prepare, maintain and publish a register of previously developed (Brownfield) land. This register must be published by 31st December 2017 and should be reviewed at least once a year.

The purpose of brownfield land registers is to provide up-to-date and consistent information on previously developed land that is considered to be appropriate for residential development. The Government hopes that this will help housebuilders to identify suitable sites quickly and speed up the construction of new homes.

The Regulations 2017 set out the criteria which local authorities have to follow in preparing and publishing a Brownfield land register. This requires that the register is provided in a spreadsheet style and published in a standard data format. The register consists of two parts; Part 1 should comprise all brownfield sites that a local planning authority has assessed as appropriate for residential development and Part 2 as a subset of Part 1 which is optional. However, Bolsover’s Brownfield Land Register currently comprises only a Part 1 register.

In total, 20 brownfield sites have been identified which comprise approximately 17.74 ha of housing land and could accommodate up to 553 dwellings. To identify these sites different sources of datasets (e.g. brownfield sites from Housing Land Availability Assessment, brownfield sites with planning permission, etc.) were utilised.

It is required that Brownfield land registers should be published in a ’csv’ format and an INSPIRE compliant polygon format. Bolsover’s Brownfield Land Register is available for download below in these required formats (and also in Excel):

We have published details of our 5 year housing supply each year since 2007. Whether the Council can demonstrate a 5 year supply of ‘deliverable’ housing is important as it affects how planning applications for new housing are determined.

Housing Objectively Assessed Need

To establish the Housing Objectively Assessed Need (OAN) for Bolsover District, in 2013 we commissioned in co-operation with our partner authorities of the North Derbyshire and Bassetlaw Housing Market Area a Strategic Housing Market Assessment (SHMA). This was updated in 2014 to take account of the updated methodology set out in the National Planning Practice Guidance. Now, in light of 2014 Sub National Population projections and the Sub National Household projections that were published in 2016, we and our partners commissioned a SHMA OAN Update report and this was completed in October 2017.

Based on this evidence, the Housing Objectively Assessed Need annual requirement for Bolsover District is 272 dwellings per year, with a base date of 1 April 2014.


2018/19 Five Year Supply update

We have updated the assessment of our 5-year supply of deliverable housing sites to take account of completions and permissions at 31 March 2018 and the proposals contained within the emerging new Local Plan for Bolsover District. This update was reported to Planning Committee at its meeting on 4 July 2018.

Based on this updated assessment, we conclude that we have just over 7.75 years supply of deliverable sites for the period 2018/19 to 2022/23. Therefore, the saved planning policies within the adopted Bolsover District Local Plan (February 2000) related to the supply of housing can be given more weight in the determination of planning applications.

Submission of Local Plan for Bolsover District

Following on from the Publication Local Plan consultation, the Council formally submitted the Local Plan for Bolsover District to the Secretary of State on 31st August 2018 and this has started the Examination process.

As required under Regulation 22 (1) of the Town and Country Planning (Local Planning) (England) Regulations 2012, our submission and supporting documents have been made available for inspection both here on our website and where practicable in our Contact Centres and at libraries across the District.

Following Submission an independent inspector will be appointed by the Secretary of State to undertake the examination of the Local Plan for Bolsover District.

The examination process will be administered by the Programme Officer, Louise St John Howe. Louise is independent from the Council and works directly to the Inspector.
