Development Plan

Introduction

The development plan for the District is currently made up of the documents below read together. Where there is any conflict between the policies contained in these documents, the policy in the most recently published, adopted or approved document prevails.

Saved policies of the Bolsover District Local Plan

Bolsover District Local Plan coverThe Bolsover District Local Plan (February 2000) contains local and site specific policies on general development issues, housing, employment, shopping and town centres, community facilities, recreation, leisure and tourism, transport, conservation of the historic and built environment. It also allocates sites for specific development. 

We asked the Secretary of State to consider action to ‘save’ many of the policies of the Bolsover District Local Plan beyond 28th September 2007 under provisions in the legislation. The Secretary of State agreed to our request and these ‘saved’ policies will remain in force until they are replaced by new policies in new development plan documents as these are adopted as part of the Local Development Framework.

Supplementary Planning Documents

We have also approved two supplementary planning documents to support certain policies of the Bolsover District Local Plan. These constitute the first local development documents to be approved as part of the Local Development Framework.

Derby and Derbyshire Minerals and Waste Local Plans

The Derby and Derbyshire Minerals Local Plan (April 2000) (as altered in November 2002) sets out planning policies for minerals development. Most of its policies have been saved and will remain in force until they are replaced by new development plan documents. The Minerals Plan is supplemented by Supplementary Planning Guidance on the After-uses of Sand and Gravel Sites.

The Derby and Derbyshire Waste Local Plan (March 2005) sets out planning policies for waste development. All but one policy (policy W1A) of the Derby and Derbyshire Waste Local Plan, adopted in March 2005, have been saved beyond March 2008.

Proposals for the replacement of these policies are contained within the Minerals and Waste Development Scheme prepared jointly by Derbyshire County Council and Derby City Council.

East Midlands Regional Plan

The East Midlands Regional Plan, approved by the Secretary of State in March 2009, forms part of the statutory development plan for the district. 

However, the Coalition Government is committed to revoking the Regional Plan through the Localism Act, which gained Royal Assent on the 15th November 2011. Subject to the outcome of the Strategic Environmental Assessment Directive process, the Coalition Government expects the orders revoking the existing Regional Plans to take effect next Spring.
