Litter and Fly Tipping

Fly tipping is the illegal dumping of waste on public or private land. Fly tipping is a crime that blights our communities, it's unsightly, can be hazardous and can lead to injuries both to the public and wildlife and is costly to remove.

We can take legal action against householders whose waste is tipped illegally (whether they know about it or not), which can end up with a fine of up to £50,000 and/or twelve months imprisonment for those found guilty of fly tipping.

Fly Tip of the Week

Every week we will bring you a 'Fly tip of the Week' showing you a picture of what someone has dumped in our countryside and in your local community. If you recognise what has been dumped, be it the wall paper, tiling, the furniture etc, or you know who in the particular area has recently had work done that may have resulted in the fly tipping, then please contact us confidentially so we can catch the culprits.

Week commencing 5th November 2012

This waste was found on Batley Lane, Pleasley at the entrance to the Skegby Trail and was probably deposited over the weekend of 10th and 11th November. We visited the site on Monday 12th November but found no evidence as to where it had come from.

Week commencing 8th October 2012

We have had two large IBC Containers dumped overnight on Tuesday 9th at Alexander Terrace, Pinxton and Wednesday 10th October 2012 on Batley lane, Pleasley.

These containers were both over half full of what we believe to be line marking paint (Environment Agency have taken samples to confirm). The first was leaking and very close to the river Erewash.  

It may be that some business has recently paid to dispose of these items – and the person removing has just dumped them. Disposal will be very costly.

Week commencing 13th August 2012

This load of asbestos was dumped on the side of a country lane on Whaley Road, just before Whaley Village overnight on 13th/14th August 2012. It is in bundles of 8 roofing sheets about nine foot long so a large vehicle and more than one person would have to have been involved in this.

 

It is likley to have come from a commercial venture, so someone has probably paid a lot of money to whoever collected and double wrapped it.

Week commencing 26th December 2011

A lady from Renishaw has been issued with a £90 Fixed Penalty Notice after the material was identified.

This occurred over the Christmas/new year period in two locations on Syday Lane, Barlborough. We believe this is from the same source (armchair in one picture is a match for the settee in the other picture) and that there must have been at least three tippings.

Week commencing 19th December 2011

There was a major fly tip between Monday 19th December and Wednesday 21st December on both sides of Millash Lane, Whitwell near the railway bridge.
There was at least 4 loads, consisting mainly of rubble and wood but contains carpets, curtains, wallpaper and a lot of old electrical fittings along with the packaging for new fittings. There is also a large sash window.

We feel it may be someone local who has had an extension knocked down, rebuilt or refurbished as the offender made several trips.

This fly tipping appeared overnight 12th to 13th December 2011 on Balkham Lane, Shirebrook in the lay by above the cemetery.

Disposal

Waste should only be disposed of on land that is controlled by a waste management licence. Household waste can be taken to a Civic Amenity Site free of charge, however charges are made to dispose of trade and commercial waste, (and that's often how rubbish ends up being dumped where it shouldn't). Disposing of waste through a third party may leave the householder (or business) liable to prosecution under the Duty of Care legislation if that waste is illegally disposed of, and they cannot show that all reasonable steps were taken to ensure that the person(s) taking the waste were licensed and legally allowed to do so.

If the waste is on the public highway or on Council owned land we will clear it away, usually within 2 working days. If the fly-tipping is on private land this will usually take longer as we have to contact the owners to get them to clear the waste.

If you come across fly tipped waste, or see someone illegally dumping rubbish, please let us know straight away. We need to know where the waste is, when it was dumped and any details you have of the offender and their vehicle.The more information you can give us, the more likely we will be able to take action. Any information you give us will be treated in the strictest confidence.

Asbestos and other hazardous materials have to be removed by specialist contractors appointed by us.
