Backdated Benefit

What is Backdated Benefit?

Housing and Council Tax Benefit can only normally be paid from the Monday following the date that you request an application form, as long as the form is returned within one calendar month of the date that you request it. The request for a form can be made in writing, over the telephone, at one of our Contact Centres or through Job Centre Plus (JCP).

We may be able to pay benefit from an earlier date, if you have 'good cause' for the delay in making a claim. This is called backdating.

What is 'Good Cause'?

If you think you have a good reason, or reasons, as to why you did not submit your form at the time that you are now requesting backdating to, you will need to write to us and request Backdated Benefit.

In your request you will need to provide:

  • The reasons that you did not apply at the relevant time, giving as much information as possible;
  • The period you want us to backdate your benefit for;
  • Any evidence that will support your request.

Some examples of 'good cause' would include:

  • A close relative had died;
  • You were not able to manage your affairs and you had no-one available who could help you;
  • You were given misleading or incorrect information from an official person, for example, officers from the Council or Department for Work and Pensions (DWP).

There are other reasons that we are able to accept as being 'good cause' for not submitting an application form at the relevant time. Each request will be considered on it's own merit.

What is not 'Good Cause'?

Examples of reasons that would generally not be considered to be 'good cause' for delaying in applying for Benefits include:

  • Not claiming because you thought you wouldn't qualify;
  • Forgetting to post your application form;
  • Having arrears of rent or council tax and needing benefit to pay them;
  • Waiting for evidence to support your application before submitting your form.

Backdating Period Limitations

Customers aged under 60:

  • The maximum backdate period is 6 months;
  • Backdating must be requested;
  • 'Good Cause' must be proven for any delay in claiming benefit for the whole backdate period.

Customers aged 60+:

  • The maximum backdate period is 3 months;
  • Backdating does not need to be requested. Benefit will automatically be considered for the previous 3 months prior to the date of your claim;
  • 'Good Cause' does not have to be proven, however we will need to see proof of all of your income and capital (and rent if applicable) for the backdating period.
